Unalachtigo Band of Lenni Lenape seeks acknowledgment
Tribe billed state $37.8 million in back taxes on claimed land

PHILADELPHIA – The chief of a tiny Indian tribe that is struggling for acknowledgment hobnobbed with some of the most experienced and high powered federal judges, telling his tribe’s story, during a black tie dinner at the 2009 Third Circuit Judicial Conference.
The conference took place at the Hyatt Regency at Penn’s Landing May 4 – 6. It was the Third Circuit’s 68th Judicial Conference and all attorneys admitted to practice in the circuit were invited to attend.
That’s why James Brent Thomas, the chief of the 50-member Unalachtigo Band of Lenni Lenape Indians, planned to attend as tribal attorney along with the Unalachtigo tribal court’s chief.
“We wanted to participate and attend the entire conference and we submitted a request for credentials and for a waiver of the fee, because we couldn’t afford the $800 conference fees, but they declined to provide us with free credentials,” he said.
Nevertheless, Thomas donned his tuxedo and black tie and attended a reception sponsored by the Third Circuit Bar Association on the first night of the conference. At the reception, Thomas was invited to have dinner with judges from the western delegation of Pennsylvania.
Speakers at the conference included Chief Justice of the United States John G. Roberts Jr.; Supreme Court Associate Justice David H. Souter; former Solicitors General Paul D. Clement, Walter Dellinger, Theodore B. Olson and Seth P. Waxman; Pennsylvania Supreme Court Chief Justice Ronald D. Castille; New Jersey Supreme Court Chief Justice Stuart Rabner; Delaware Supreme Court Chief Justice Myron T. Steele; and many more.
Roberts was the featured speaker at the dinner.
“Justice Roberts gave a tremendous speech where he compared himself to Justice Marshall,” Thomas said.
He said the evening yielded two benefits.
The first was a meeting with New Jersey U.S. District Court Senior Judge Stanley Brotman, who settled a dispute a few years ago between the Unalachtigos and their “cousin” tribe, the Nanticoke Lenni Lenape Tribe.
“The state is trying to make us invisible by writing us out of our history, but Justice Brotman was the only man that wouldn’t allow them to do that. He is very gracious. That’s why I was so happy to see him,” Thomas said.
The other benefit was “the opportunity to share our story with many of the federal judges, lawyers and other decision makers in the Third Circuit and beyond, and bring to light our efforts to resolve our struggles through the federal court process.”
Thomas’ tribe, which is neither state nor federally recognized, is embroiled in a number of legal actions. The tribe has filed land claims in federal court for 3,044 acres in central New Jersey based on a 1758 treaty and the violation of the 1790 Non-Intercourse Act. In addition, Thomas has filed two hate crime lawsuits in the same federal district court. The tribe is also fighting the state’s attempt to evict his 78-year-old mother from public housing.
And last month, the tribe sent a bill to New Jersey Gov. John Corzine for $37.8 million in back taxes on the 3,044 acres.
“We want all the cases to be combined and disposed of at the same time because they all flow from the same question of whether or not we have the right to be on the land and sovereign right to govern ourselves and, ultimately, provide a high quality of life for our people,” Thomas said.
The federal court ruled last May that the Unalachtigo Tribe and the Stockbridge Munsee Tribe, which also claims the land, have not proven they are the proper successors to the 1758 treaty.
The Unalachtigos appealed to the Third Circuit, which ordered the tribe to get an attorney or the appeal would be dismissed.
Although, just two years ago the tribe had large plans for a $5 billion gaming resort and residential community, Thomas said the tribe is poverty-stricken, has no financial backers, and gaming is off the table now.
All of the tribe’s legal briefs are written and defended by Thomas, who acquired his skills in legal argument during a brief jail sentence in 1990.
The case was dismissed, but Thomas has filed a motion for reinstatement and so far has unsuccessfully sought pro bono representation.
But Thomas is determined to move forward.
“We’re hoping that Chief Justice Anthony Sirica, the head of the Third Circuit Court of Appeals, will take this case on himself.”

What? You can call yourself a lawyer if you read a few law books in the jailhouse library? Guess that's cheaper than 3 years of law school.
But, you know what they say about representing yourself . . . Any lawyer who defends himself has a fool for a client.

Foundation Founder Is Jailed

James Brent Thomas of Bridgeton has raised scholarship money to help area students from poor families defray college expenses. He has solicited funds from area businesses to help young athletes meet the expenses of competing in the Junior Olympics.
Now, James Brent Thomas, founder of the Thomas Foundation, is in jail.
County sheriff's officers arrested him earlier this week at his parents' home in Fairfield Township on a fugitive's warrant, said Capt. Edward Webster.
Thomas, 30, is in Cumberland County Jail waiting for his extradition to Harris County, Texas, where he is wanted for violating probation following convictions there of auto theft and theft, Webster said.
Webster said the Harris County Sheriffs Dept. probably found out Thomas was in Bridgeton when they ran a check of his name through the National Crime Information Center.
"They probably did the same thing we do," Webster said."Once in a while they check NCIC and see if someone they are looking for has been arrested someplace else."
Thomas name popped up on the computer because he was arrested in Bridgeton Feb. 9 on arson, theft, fraud and conspiracy charges, Webster said.

Bridgeton police arrested Thomas and 2 others in connection with the torching of a limousine earlier this month.
An investigation revealed Thomas leased the limo from a Philadelphia firm to make a profit by sub-leasing it, police said. When he couldn't meet the monthly payments of $10,000 the company moved to repossess the vehicle authorities said.
Thomas allegedly conspired with two others to report the limo stolen, then, sell it to a "chop shop" in Camden, where it would be disassembled and the parts resold below market value.
The vehicle was reported stolen from the parking lot of a Vineland diner, but the trio decided to burn it than take it to a chop shop, police said.
No indictment has been handed up in the case, which is still a open complaint in the Cumberland County Prosecutors Office, according to court records.
Thomas did not resist Monday,when Det. Brian Wentz and Patricia Mason of the sheriff's department arrested him on the fugitives warrant authorities said.
Webster said Thomas is self employed as a financial consultant for Capital Expansion Inc., of which the Thomas Foundation apparently is a offshoot.
Webster said he he knows nothing about either organization.
Thomas, whose residence is listed as Finlaw Ave., Bridgeton has gained publicity recently by raising money through the foundation to help disadvantaged youths.
Two $1,000 foundation scholarships were awarded earlier this month to eligible student and checks for about $150 each were awarded to two area athletes before they were to compete in the Junior Olympics.
Thomas has organized a local gof tournament Sept. 30 to raise money for the for the foundation drawing the Phila. branch of the Coca Cola Company as at least one sponsor according to a employee of the Holly Hills Golf Course in Alloway Twp.
Webster said no other investigation of Thomas is planned. "At this point we are doing nothing about it, the case is closed." He said.
A spokesman for the state Division of Consumer Affairs that neith of Thomas' organizations is registered with the state Office of Charitable Organizations.
"We never heard of them and have no paperwork on them,"said division spokesman George Danco. "If someone solicits donations from the public they're required to register," he said.
Charitable organizations seeking tax-exempt status also must seek approval from the federal Internal Revenue Service by applying to the agency's exempt organization section, but a IRS spokeswoman in Newark could not verify Friday whether the Thomas foundation had applied.

He spent 3 years in prison here. I have more but I'm not ready to do that much typing yet.
He has a "gag order" on members of my tribe to keep from talking about this stuff. But since I'm not enrolled I don't count.

He always signs his name Hon. James Brent Thomas Sr. and calls himself Hon. Kschuppehellen- War Chief. I don't know where the "Honorable" part comes in.
He claimed to be a Africa art dealer involved with a gallery in KwaZulu-Natal according to Ned Heite. Ned also wrote that "he had a contempt for people who are interested in nothing but culture and family". Ned also wrote that he requested he fax geneological research that would take "2 years" to send him. Ned also wrote that Thomas stated "we are planning to submit legal action to have the racial records of the past changed".
Out of his 127 "enrolled" members, 43 are living. Some of those on his list claim to have nothing to do with him.

Thomas was just indicted in Cape May or Atlantic Counties for squatting on someone's boat. A prosecutor detective called the Naqnticoke-Lenape Tribal Office looking for info because he claimed to be tribal chairman again. I'm looking for the indictment now.

Brent Thomas and John Norwood
This week at the Smithsonian in Washington J. Brent Thomas and a unnamed woman approached John Norwood and asked for a picture. John immediately declined. Brent then hurriedly approached John and shook his hand while the woman that was with him snapped a picture. John really came apart about this and called me.
The picture of J. Brent Thomas and John Norwood was taken without John's permission and "on the sly". It was not authorized and Dr. Norwood is very upset about it.
Dr. John Norwood is a kind and gentle man and a pastor who acts as he speaks. Brent took advantage of his nature and now it is feared that this picture will be used in one of his (Brent's) many cons..
